These rules apply to all games, giveaways, draws and prize competitions (each a "Game" and, together, the “Games”) organised and operated by Plant Addicts UK, its owners and moderators.
1. Status. Games include a test of skill and/or knowledge to be eligible to participate, which will always be the only or first stage of selection; no Game requiring any payment shall rely wholly on chance. As such, in accordance with section 14(5) of the Lotteries and the Gambling Act 2005, each Game will be a prize draw, giveaway or prize competition, and shall therefore not constitute a lottery. Each Game will be hosted on our Discord server (“Server”) and/or website at https://sites.google.com/view/plantaddictsuk/home ("Site") and will start when we post details of that Game (“Details”) on that Server (including, but not limited to: (a) a photo and description of the plant or plant-related item being offered as a prize (“Prize”); (b) the cost of entry (“Entry Fee”) (if any); (c) the maximum number of entries that will be accepted before the Game is closed (“Maximum Entries”) (if applicable); (d) the link to the skill question on the Site that you must answer successfully to be included in the draw (“Skill Question”) (if the Game is a prize competition); or (e) the rules of the Game and conditions for winning (for Games other than prize competitions) (“Win Condition(s)”).
2. Eligibility. Games are open to UK residents aged 18 or over. By entering a Game and paying the Entry Fee (if any), you warrant that you meet these requirements. If you do not, you must not play any Game and we reserve the right to reject/refuse your entries (including, but not limited to, without any refund).
3. How to Enter. Subject to your eligibility in accordance with Paragraph 2 above, we will accept entries for a Game (each an “Entry” and, together the “Entries”) from the date/time that its Details are published on the Server until the number of Entries reaches the Maximum Entries (or, if sooner, the date/time when we otherwise announce that the Game is closed, or will close, on the Server). To enter a Game that is a prize competition, you must: (a) pay the Entry Fee; (b) provide evidence of payment of the Entry Fee as a screenshot posted on the Server; and (c) answer the Skill Question on the relevant page of the Site as specified in the Details on the Server (or such other method as we may require from time to time). To enter a Game other than a prize competition, you must: (a) pay the Entry Fee (if any); (b) provide evidence of payment of the Entry Fee as a screenshot posted on the Server (if applicable); and (c) meet the Win Condition(s) and/or other conditions as set out in the Details on the relevant page of the Site, the Server or such other method as we may require from time to time. Multiple Entries are allowed up to the Maximum Entries, unless we otherwise confirm. Entry is subject to availability. Payment must be made via Square, bank transfer or other payment method as we may direct from time to time in the Server and/or on the Site.
4. Winner selection. Each valid/correct Entry complying with the applicable Win Condition(s) (and, in the case of a Game that is a prize competition, subject always to you first successfully answering the Skill Question) will, subject to eligibility (Paragraph 2), be added to a verifiable random-number generator (“Wheel”) and a winner will be chosen at random from those correct Entries using the Wheel soon as reasonably possible after the Game closes, save in the event that the Game operates by “first past the post” method, where the first person with a valid Entry to meet the Win Conditions shall be declared the winner of that Game. A recording of any random selection of the winner using the Wheel method will be posted on the Server to announce the winner. We will then contact the winner directly to arrange delivery of the Prize. No cash or alternatives will be offered. In the event of any dispute regarding the winner, we shall determine the winner and our decision shall be final.
5. Cancellations/refunds. If enough valid Entries are not received, we may cancel that Game and you may transfer your Entries to another Game. Entries are non-refundable once submitted in all other cases.
6. Fairness and transparency. We run our Games fairly and transparently. We will keep a record of all results for at least 14 days after the draw. We reserve the right to disqualify any Entry that is fraudulent, incomplete or which otherwise breaches these Rules.
7. Governing law. These Rules are governed by the laws of, and all disputes will be subject to the jurisdiction of the courts of, England and Wales.
